El primer paso para que eso suceda es definir sus objetivos de donaciones caritativas. Las donaciones caritativas pueden tomar muchas formas y pueden dirigirse a un número aparentemente interminable de beneficiarios. Es posible que no pueda continuar con todas sus donaciones caritativas en su plan de sucesión; sin embargo, ciertamente puede incorporar lo suficiente como para que forme parte de su legado. Donaciones caritativas hechas en su última voluntad y testamento

Para empezar, usar su testamento para hacer donaciones caritativas significa que casi seguramente se perderá los beneficios fiscales que de otro modo estarían disponibles al hacer donaciones caritativas. Además, cuando haces un regalo directo en tu testamento, pierdes todo el control sobre cómo se usa ese regalo una vez que se completa la transferencia y el regalo podría desperdiciarse en lugar de durar los años venideros como pretendías. Finalmente, si espera involucrar a sus hijos, u otros parientes más jóvenes, en sus esfuerzos filantrópicos, deberá usar un método más complejo para continuar su trabajo de caridad.

Opciones de Donaciones Caritativas

Si su objetivo es continuar con sus donaciones caritativas después de que se haya ido e incluirlas como parte de su legado, es posible que desee considerar las siguientes opciones:

  • Charitable Lead o Charitable Remainder Trust. Los fideicomisos de plomo y remanente caritativo charitable son fideicomisos especializados que le permiten donar tanto a un beneficiario caritativo como a un beneficiario no caritativo. Con un fideicomiso caritativo principal (CLT), un beneficiario caritativo recibe distribuciones del fideicomiso por un período específico primero. Debido al costo involucrado en la creación y operación de una fundación, esta opción solo es práctica si planea donar una cantidad considerable a la caridad en su plan de sucesión. Junto con numerosas ventajas fiscales, uno de los mayores beneficios de crear una fundación privada es que le brinda la oportunidad de involucrar a las generaciones futuras en donaciones filantrópicas de manera práctica. Como creador de la fundación, puede establecer pautas sobre qué tipo de donaciones se realizarán y qué tipo de beneficiarios se considerarán; sin embargo, sus hijos, nietos y generaciones futuras podrán experimentar donaciones caritativas de primera mano a través de la operación de la fundación.
