Todos los fideicomisos se pueden dividir ampliamente en dos categorías: fideicomisos testamentarios o vivos (inter vivos).   • Evitación de sucesiones. La evitación de sucesiones es un objetivo secundario que se encuentra en muchos planes de sucesión porque la sucesión es costosa, tanto en términos del tiempo como del dinero gastado en la sucesión de un patrimonio. Los activos mantenidos en un fideicomiso, sin embargo, evitan la sucesión por completo.  En consecuencia, los activos mantenidos en un fideicomiso en vida se pueden distribuir a sus seres queridos tan pronto como lo desee. Esto permite a sus beneficiarios previstos acceder a activos muy necesarios de inmediato en lugar de tener que esperar a la conclusión del proceso de sucesión, que puede tardar meses, incluso años, en terminar.
  • Escalonar una herencia. Los regalos hechos en su testamento se distribuyen al beneficiario nombrado en una suma global. A veces, esa no es una gran idea. Los beneficiarios jóvenes, los beneficiarios derrochadores o aquellos que han luchado contra la adicción en el pasado no deben recibir una gran suma de dinero.   • Privacidad. Si la privacidad le importa, se debe considerar un fideicomiso en vida porque los términos de un testamento se convierten en un asunto de registro público cuando el testamento se presenta para la sucesión. Si prefiere que los términos de su plan de sucesión permanezcan privados, un fideicomiso es la mejor opción, ya que los términos de un fideicomiso no se hacen públicos.
  • Control sobre cómo se utilizan los activos. A pesar de que ya no estará aquí, la idea de que su dinero ganado por oídos se desperdicie o desperdicie probablemente no le sienta bien. Desafortunadamente, sin embargo, una vez que se hace un regalo en un testamento, se convierte en propiedad exclusiva del beneficiario para hacer lo que le plazca. Sin embargo, un fideicomiso en vida le ofrece la capacidad de usar los términos del fideicomiso para mantener un cierto grado de control sobre cómo se pueden usar los activos que usted dona.
