The most important part of the successful estate planning is the lawyer that you choose who will both design and draft everything. This relationship is almost as important as the one form between the attorney and professional advisers who serve you by offering financial advice an accounting. For estate planning to be successful there are several different professions who work together to look after the best interest of the client. For the most part lawyers who base their practices on estate planning are very values that based, relationship driven, client-centered and counseling oriented people. Any good lawyer will be willing to work with anybody up any other profession if it is going to benefit the client. The key here is to find this kind of attorney who understands that to thoroughly and efficiently get through estate planning the client is going to need more than just their legal advice. This person understands the process and the entire complex system that is LA Probate Law.

Your question may be” How do I find one of these”?

How can you tell if you’re dealing with the right kind of lawyer? It’s really simple as you are searching for an attorney look for somebody whose orientation is focused towards relationship-building and counseling as opposed to mere document preparation. When you go in for your consultation a good attorney will automatically offer an ear to listen not just to your goals but also the aspiration you have for your loved ones in the event of your death. They will understand that this is not an easy thing for anyone to do and be sensitive to your wishes of maintaining control of your affairs. They will also understand the importance of caring properly for you in the event of disability or providing for your loved ones when you are gone. With their knowledge of LA Probate Law it will be able to guide you gently through this process with as little discomfort as possible. The event of their death is not something that anybody likes to think about and a good probate lawyer understands this.


It’s not just about taxes…

Any lawyer who is experienced with LA Probate Law can guide you through all of the legal intricacies and laws regarding taxes that come up when discussing the passing of wealth. However of good estate planning lawyer is also interested in their client’s desire to leave behind more than just money to their loved ones. A good lawyer will also explain to you how you can set up and arrange for such things and as future funding of your children’s education as well as the education for future generations beyond your own children, meeting your goals that will allow you to leave a legacy within your community as well as preserving your family history and the stories that support all the values that you believe in. Here she will also explain how you can arrange for the support of your surviving spouse regardless of circumstances and continuing or divesting a family business. This type of lawyer is interested in not just the technicalities of your case the genuinely interested in seeing to your well-being and the future well-being of your loved ones. Even though these may be a harder subjects to breach an attorney who is genuinely concerned will also discuss with you family relationships that may exist because a second marriages, special needs of the grandchild, if there is a son or daughter-in-law who you feel is not to be trusted or if one of your loved ones is a spendthrift or sufferers from substance abuse. This type of in death counseling creates a foundation with which you and your lawyer will base and long-term relationship off of. Both you and your lawyer need to understand that this is not a transaction between the two of you, rather an ongoing process that you both need to review and revise from time to time throughout your life. This relationship is also one that may span generations. If you choose to involve your adult children in the planning and the process a good Atty. will also build the same relationship with them as he has with you.

An Interdisciplinary Approach

If an attorney has a team approach in his estate planning this is a good sign. He understands and recognizes that every member and every person that is involved is equally important to the success of this plan. You will involve everybody who is a part of the team and encourage their long-term relationship-building with you as well. Their times the legal documents just simply are not enough. Even when they have been carefully drafted through counseling and sort of custom-designed to encompass all of the unique needs of each individual client, they just simply sometimes are not enough. The plans and instructions within these documents only cover assets that are properly owned. For example when you make a Will the only assets that are covered our properties directly owned by the client, not any properties that are jointly owned with somebody else. In the instance of a trust this only controls what is owned by the trustee. As well as any irrevocable Life Insurance Trust, this only works if it is been properly funded with a suitable insurance policy. Acquiring proper and precise values of all of your business interest is imperative. Acquiring a probate lawyer who knows all of the ins and outs of LA Probate Law is something you must take seriously and take time to make sure you find one who fits your needs.
