¿Es Hora de Actualizar a Sus Beneficiarios?

Si ya tiene un plan de sucesión en su lugar, ya comprende la importancia de una planificación patrimonial cuidadosa y exhaustiva. Sin embargo, tomarse el tiempo para crear ese plan es solo el primer paso para proteger a todos y todo lo que es importante para usted.  Para que el plan patrimonial que creó funcione según lo previsto, debe modificarse de vez en cuando. Eso puede requerir que agregue o elimine herramientas de planificación patrimonial o incluso componentes completos. También puede requerir que actualice a los beneficiarios según lo explicado por los abogados de planificación patrimonial de Los Ángeles en Schomer Law Group, APC.

Los Beneficiarios Están en Todas Partes en Su Plan de Sucesión

Si bien su plan de sucesión también puede lograr una amplia gama de objetivos adicionales, el objetivo principal de la mayoría de los planes es garantizar que los activos se distribuyan de acuerdo con los deseos del creador después de su muerte.  Dentro de ese objetivo general está el deseo de asegurarse de que sus seres queridos estén financieramente seguros en su ausencia.  Eso significa que muchos de sus documentos / componentes de planificación patrimonial incluirán al menos un beneficiario, que incluye:

  • Última Voluntad y Testamento
  • Acuerdo de fideicomiso
  • 401(k) o IRA
  • Póliza de seguro de vida
  • Cuentas financieras
  • Cuentas de inversión

¿Cuándo Deben Actualizarse los Beneficiarios?

Todos sus planes patrimoniales se someten a una revisión y revisión de rutina cada pocos años para asegurarse de que refleje sus objetivos y deseos actuales.  Cuando realice una revisión de rutina de su plan de sucesión, asegúrese de prestar atención a las designaciones de sus beneficiarios para mantenerlas actualizadas. Sin embargo, hay ciertos eventos o desencadenantes que deberían llevarlo a realizar una modificación más inmediata a las designaciones de beneficiarios dentro de su plan de sucesión, tales como:

  • Nacimiento de un beneficiario.  Idealmente, los documentos de su plan existentes deben tener en cuenta a los futuros beneficiarios  (aún no nacidos) con un lenguaje genérico e inclusivo, como “descendientes”. Sin embargo, siempre es mejor usar el nombre real de un beneficiario una vez que él / ella nace para aliviar la posibilidad de confusión y reducir la probabilidad de litigio en el futuro.
  • Fallecimiento de un beneficiario. Lo mismo ocurre en el caso de un beneficiario que fallece. Ynuestro plan existente debe contemplar la posibilidad de incluir a los beneficiarios sucesores y / o proporcionar instrucciones sobre cómo se deben manejar los activos en caso de muerte de un beneficiario. Sin embargo, si tiene conocimiento de la muerte de un beneficiario, siempre es mejor actualizar sus designaciones para hacer que el sucesor sea el beneficiario principal y nombrar un nuevo sucesor o hacer planes alternativos para los activos involucrados a la luz de la muerte del beneficiario.
  • Matrimonio. Claramente, querrá revisar y actualizar a sus beneficiarios si se casa; sin embargo, el matrimonio de un hijo adulto también podría llevarlo a agregar o eliminar un beneficiario, dependiendo de sus sentimientos sobre su nuevo hijo o nuera.
  • Divorcio. Si pasa por un divorcio, es probable que desee actualizar a sus beneficiarios lo antes posible para asegurarse de que su ahora ex cónyuge no herede todo su patrimonio.  Sin embargo, consulte primero con su abogado de planificación patrimonial y / o divorcio, ya que es posible que legalmente no pueda cambiar a un beneficiario hasta que se finalice el divorcio.
  • Beneficiario que alcanza la mayoría de edad. Su hijo menor de edad no puede heredar directamente de su patrimonio. Como tal, es posible que tenga un fideicomiso para proteger los activos destinados a su hijo menor de edad. Sin embargo, si su hijo ha alcanzado la edad adulta, ahora es posible agregar a su hijo como  beneficiario directo a lo largo de su plan de sucesión si decide hacerlo.
  • Nuevas cuentas/política/documento. En el aluvión de papeleo que a menudo se impone a un nuevo empleado, puede ser fácil pasar por alto los documentos. Eso puede llevar a no nombrar a los beneficiarios en las cuentas de jubilación, inversión y financieras, lo que hace que los activos mantenidos en la cuenta se conviertan en parte de su patrimonio intestado.
