First of all, the will of a deceased person is proved by an affidavit. This affidavit can be done depending on the oath of the witness of the will. After proving the will, it is sent to the court. If the will is considered as invalid, the witnesses are needed to be present at the court to make sure that they have signed while making the will. They have to make sure that the deceased person was mentally well while making the will and he or she had signed the will knowing what he or she was doing. Simply, they have to prove that the will is completely valid and this is one of the most important steps of the process. A personal representative also can play the role of the witness who will handle the affairs. When a person dies without writing a will the court will bring the personal representative. The personal representative can be an adult child, spouse and other relative of the dead person. If there is no one available for becoming the personal representative, a trust company, a bank or a lawyer can be selected by the bank. Then, a notice is published in a local newspaper. The personal representative is responsible for preparing the documents. The person needs to submit an account in the name of the will. The account is needed to be paid from the property and assets. Then the court will approve the amount of the paid money. There are strict guidelines in the probate law and the court follows it step by step.
